A First-Of-Its-Kind Compensation Decision

On September 24, 2025, the Commission released its first-ever decision following a compensation hearing. When the Canadian Energy Regulator Act (CER Act) came into force in 2019, it brought in a new mandate giving the Commission the authority to determine compensation for the use of land or for damage that results from the construction of a pipeline. Prior to this time, parties could apply to the Minister of Natural Resources Canada to receive the services of a negotiator or to have the dispute settled by arbitration.
Although the CER has received numerous compensation applications since the CER Act came into force, the majority of the applications have been withdrawn prior to a hearing taking place. This is in no small part due to the successful work of the CER’s Alternative Dispute Resolution team, who work closely with landowners and companies to help them reach mutually beneficial agreements.
